Agreement to Terms

By accessing or using macfor's website, software, or services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access our Services.

Description of Services

macfor provides:

  • macfor Collector: Software for macOS forensic artifact collection
  • macfor Analyze: Analysis platform for forensic investigations (coming soon)
  • Website: Information, documentation, and support resources
  • Support Services: Technical assistance for licensed users

License Grants

Community Edition (MIT License)

macfor Collector Community Edition is licensed under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions in the MIT License.

Professional and Enterprise Editions

Professional and Enterprise editions are licensed under our Commercial License Agreement, provided upon purchase. Key terms include:

  • License is per-user and non-transferable
  • Usage limited to your organisation
  • Redistribution prohibited
  • Source code access not included

User Responsibilities

You agree to:

  • Use the Services only for lawful purposes
  • Comply with all applicable laws and regulations
  • Not attempt to circumvent license restrictions
  • Not reverse engineer proprietary components
  • Provide accurate information when creating accounts
  • Maintain the security of your account credentials

Forensic Use Disclaimer

macfor provides forensic tools for legitimate investigative purposes. Users are responsible for:

  • Ensuring legal authority to collect evidence
  • Complying with applicable privacy and data protection laws
  • Maintaining proper chain of custody
  • Using collected evidence appropriately

We do not provide legal advice. Consult qualified legal counsel for guidance on evidence admissibility and investigative procedures.

Payment Terms

For paid Services:

  • Prices are in USD unless otherwise stated
  • Payment is due upon invoice or as specified
  • Subscriptions renew automatically unless cancelled
  • Refunds are provided per our refund policy
  • We may change prices with 30 days' notice

Intellectual Property

  • "macfor" and our logo are trademarks of macfor Pty Ltd
  • Documentation and website content are copyrighted
  • Open source components retain their respective licenses
  • User-generated content remains your property

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • Services will be uninterrupted or error-free
  • Defects will be corrected
  • Services are free of viruses or harmful components
  • Results from Services will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACFOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claim shall not exceed the amount paid by you for the Services in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless macfor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your forensic activities using our tools

Termination

We may terminate or suspend your access to Services immediately, without notice, for:

  • Violation of these Terms
  • Non-payment of fees
  • Suspected fraudulent or illegal activity
  • At our sole discretion for any reason

Upon termination, your license to use paid Services ends. Provisions that by their nature should survive termination will survive.

Changes to Terms

We may modify these Terms at any time. We'll provide notice of material changes via email or website announcement. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Disputes shall be resolved in the courts of New South Wales.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy and any applicable License Agreement, constitute the entire agreement between you and macfor regarding the Services.
